1Introduction

Welcome to Kiwi WorkConnect! We're glad you're considering our service to help you find seasonal workers.

These Terms and Conditions explain how our service works, what you're paying for, and what to expect. We believe in being completely transparent, so please read this carefully before submitting a worker request.

2What Kiwi WorkConnect Does

2.1 Our Service

Kiwi WorkConnect provides a labour connection service. Specifically, we:

• Maintain a database of working holiday makers actively seeking seasonal work in New Zealand
• Screen travelers to ensure they have appropriate visas and availability
• Match employers with travelers based on location, dates, and work type
• Facilitate introductions by connecting travelers directly with your opportunity
• Provide travelers with your contact details so they can apply to you directly

2.2 What We Don't Do

To be absolutely clear, Kiwi WorkConnect does NOT:

• ❌ Act as an employer
• ❌ Guarantee placements or hires
• ❌ Manage employment relationships
• ❌ Handle payroll, contracts, or taxes
• ❌ Supervise workers on your property
• ❌ Process visa applications
• ❌ Provide accommodation

You are the employer. All employment relationships, contracts, and legal obligations are solely between you and the workers you choose to hire.

3Pricing & Billing Model

3.1 Our Fee Structure

Our fee is $1.05 per person per hour (including GST), calculated as:

3.2 What You're Paying For

When you pay our fee, you're paying for the connection service, which includes:

• Database Access: We've built and maintain a database of pre-screened working holiday makers
• Matching Service: We identify travelers who match your specific requirements (location, dates, availability)
• Introduction Service: We connect qualified candidates with your opportunity via direct email
• Contact Facilitation: We provide candidates with your contact details so they can apply directly to you

3.3 Fair Use Policy

We will connect you with qualified candidates based on your request:

• If you request 5 workers and we have 8 qualified candidates, we'll send all 8
• If you request 10 workers and we have 6 qualified candidates, we'll send all 6
• We typically aim to send between 1× to 2× your requested number to give you good choice

Your invoice will be based on the actual number of candidates we connect you with, capped at a reasonable multiple of your request.

• Invoice Date: We will invoice you within 48 hours of connecting candidates with your opportunity
• Payment Due: Payment is due within 7 days of invoice date
• Payment Methods: Bank transfer (details on invoice)

5Your Responsibilities as Employer

When you hire workers through Kiwi WorkConnect, you are the employer. This means you are solely responsible for:

5.1 Legal Compliance

• Verifying each worker's visa status and right to work in New Zealand
• Complying with all NZ employment law including minimum wage, breaks, and leave entitlements
• Providing written employment agreements
• Meeting Health & Safety at Work Act 2015 obligations
• ACC employer obligations and levies
• PAYE tax deductions and employer contributions

5.2 Day-to-Day Management

• Interviewing and selecting which candidates to hire
• Setting pay rates, hours, and working conditions
• Providing adequate training and supervision
• Managing workplace issues and performance
• Handling any employment disputes or grievances

6Service Limitations & No Guarantees

6.1 No Placement Guarantees

We cannot and do not guarantee:

• That you will hire any or all candidates we introduce
• That candidates will accept your job offer
• That candidates will complete the full duration of work
• The work performance or reliability of any candidate
• That candidates' visa or circumstances won't change

6.2 What We CAN Promise

What we DO guarantee:

• All candidates sent to you are active in our database and seeking work
• All candidates match your location and date requirements
• All candidates have indicated they hold appropriate working visas
• We will send you at least the number of candidates you requested (if available in our database)

6.3 Database Availability

If we have NO qualified candidates matching your requirements at the time of your request:

• We will notify you immediately
• No fee will be charged
• We can either cancel your request or keep it on file for future matches

7Acceptance of Terms

By submitting a worker request through our website, you confirm that:

• You have read and understood these Terms and Conditions
• You agree to our pricing model and payment terms
• You understand that you are the employer and accept all associated responsibilities
• You understand that our fee is for connection services, not placement guarantees
• You agree to pay our invoice within 7 days of receiving candidate introductions
